General Terms and Conditions of Business (GTC)


Data protection

All customer information is subject to Swiss data protection laws. We undertake to refrain from selling or passing customer data to third parties.

Credit card information is encrypted. In addition, all transactions are authorized and checked online by the requisite credit card companies.


General

All our deliveries and services are provided on the basis of the following T&Cs in the version valid at the time of ordering. These T&Cs apply indefinitely unless amended or changed in writing by the Parties. Otherwise, the sale agreement is governed by the provisions of the OR (Swiss Code of Obligations) and other Swiss laws and regulations. If a provision of these T&Cs is invalid or if an omission is found, the validity of the remaining provisions will be unaffected. The invalid provision will be replaced by a valid provision that most nearly approaches the business intentions of the parties and will be deemed to have been agreed from the outset. The same applies mutatis mutandis to omissions.


Orders

Orders are only accepted in writing through our website, by email or by post. An order is binding for the customer as soon as it is submitted. Sending the order serves as the customer’s confirmation that he/she is of full age and capacity.  

The customer undertakes to accept and pay for the goods when the order is completed. In the case of unjustified refusal to accept the goods consigned by us, we will charge the customer for any costs incurred by us. Our right to fulfilment of the sale agreement remains unaffected.


Place of fulfilment and jurisdiction

Unless otherwise expressly agreed (in writing), our current business domicile is the place of fulfilment for our delivery of goods and for your payment of the purchase price.

Our current business domicile is the place of jurisdiction. However, we may also call upon the court at the customer’s domicile. Swiss law applies exclusively, including to orders placed from abroad or delivered to addresses abroad. The parties will endeavour to resolve any disputes arising from the execution of this agreement amicably.

These General Terms and Conditions are deemed accepted by the customer upon the customer’s placing of an order. Any amendments or additions to the General Terms and Conditions are made exclusively by us and must be made in writing.


Delivery / Performance

Deliveries are made from Switzerland to Switzerland, France, Austria and Germany, usually within 7 – 10 days.


Terms of payment

All prices are given inclusive of VAT, the import sales tax of the country of delivery. Prices are as shown for the specified country of delivery at the time of ordering.

In general, goods are only shipped after payment has been confirmed by credit card or receipt of bank transfer.

Deliveries against invoice at the customer’s request are limited to orders within Switzerland. Payment is due within 10 days.

If payment is not received within this period, requiring a reminder or final reminder to be sent to the customer by email or post, an additional charge of CHF 20 will be payable in addition to the invoiced amount.


Returns

Complaints or exchange requests by the customer must be received by us in writing by email or post within 7 days after the customer’s receipt of the goods. We will notify the customer promptly of the address to which the returned goods should be sent.

We reserve the right to refuse returned goods where the goods are not in brand-new condition, in the original packaging and/or in flawless hygienic condition or cannot be returned for hygiene reasons. If the customer furnishes evidence of faults in the delivered products, we will either remedy the fault or replace the products within a reasonable period. If this is unsuccessful, the customer has the right to withdraw from the purchase or request a reduction in the purchase price.


Retention of title

We retain ownership of the merchandise until all payments arising from the sale agreement have been received.


Liability

We accept no liability for delays in delivery, for non-availability of merchandise, for personal injury or for damage to property. Neither do we accept liability for personal injury or damage to property arising from use of the merchandise supplied by us.

The customer is not entitled to offset our payment demands with his/her own claims. Compensation claims based on faults in illustrations, prices or texts or on delayed or non-delivery are strictly excluded.

The place of jurisdiction is the current domicile of our company in all cases. Our products are inspected and examined to the best of our knowledge. All our merchandise complies with Swiss law.
